Andrew is of counsel in the Litigation & Dispute Resolution and Intellectual Property practices, leveraging more than two decades of trial and litigation experience with patent litigation disputes in district courts and before the U.S. International Trade Commission (“ITC”), where he represents clients in high-stakes, fast-moving Section 337 investigations that can result in the exclusion of products from the U.S.
Andrew’s notable 10-year tenure as Senior Investigative Attorney in the ITC’s Office of Unfair Import Investigations (“OUII”) equips him with a unique perspective and a comprehensive understanding of complex intellectual property matters and how the ITC operates. In that role, he represented the public interest in numerous Section 337 investigations at the violation stage and in remand, enforcement, and 100-day proceedings. His work encompassed a variety of issues, from utility patents — including Standard Essential Patents — to trade secrets, trademarks, trade dress, and design patents. Andrew was lead counsel in multiple claim construction hearings and served as lead hearing/trial counsel in 10 trials concerning patent infringement and trade secret misappropriation, his position prevailing in all of the hearings. His experience spans a diverse range of technologies, such as crawler cranes, switch and router operating systems, vehicle camera mounts, flash memory, magnetic data tapes, and automotive motor assemblies.
Beyond his experience with complex patent litigation on behalf of plaintiffs and defendants, Andrew also provides one-on-one IP counseling, including licensing and risk and portfolio analysis, for domestic and international clients of all sizes. He has also successfully assisted clients in petitioning the U.S. Patent and Trademark Office to revive abandoned patent applications.
A sought-after thought leader, Andrew has authored articles addressing intellectual property issues for outlets such as IP Watchdog and JD Supra and shared his insights and viewpoints at various industry conferences and bar association meetings.
